SL5 Legal is pleased to highlight the excellent work of Yasmin Karabasic, who recently achieved a significant outcome for her client.
At his first parole review on his extended determinate sentence, the client sought release. Despite unanimous professional recommendations supporting release, the Parole Board panel refused the application. Recognising that the decision was flawed, Yasmin promptly lodged an application for reconsideration on her client’s behalf.
The Parole Board granted the reconsideration application, agreeing with her argument that the original decision was irrational, applying the well-established Wednesbury test.
In granting the application, the Board noted that the panel’s rejection of the professionals’ assessments and recommendations could not be reasonably justified and therefore fell outside the bounds of lawful decision-making.
This successful challenge highlights Yasmin’s commitment, expertise and meticulous approach to ensuring that decisions affecting her clients’ liberty are made fairly and in accordance with the law.
