For several years, Lisa has represented a life-sentenced client who, despite an exemplary custodial record and dozens of incident-free temporary releases on license, was refused parole after his oral hearing a few months ago.
The Parole Board's decision letter blamed “unknown” future risks and consigned him to another 13 months in closed conditions, a blow that left her client and his family devastated.
Lisa challenged the decision via the Parole Board’s Reconsideration Mechanism, arguing that the panel’s decision was irrational, procedurally unfair and a clear mis-reading of the legal test for release.
Her submissions highlighted unanimous professional evidence supporting release and the client’s outstanding conduct. Within weeks, the decision was quashed and directions made for a further oral hearing in front of a fresh panel.
At the second oral hearing, Lisa was able to persuade the new panel that her client could safely be released. The new panel directed immediate release, not to an approved premises, but straight home to his mum's address. Her client can now begin rebuilding his life.
